We reserve the right to modify these terms at any time. We will notify users of any material changes. Your continued use of the services after such notification constitutes acceptance of the modified terms.
These terms apply to all users of Regatta RC, including race organizers, sailors, spectators, and administrators.
Acceptance of Terms
By creating an account or using Regatta RC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
Use of Services
You agree to use Regatta RC only for lawful purposes and in accordance with these terms. You must not use the services in any way that violates applicable laws or regulations.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Yacht Racing and Event Management
Regatta RC provides software for the management and scoring of yacht racing events. The software is provided as a tool to assist race committees, organizing authorities, and clubs. Results, handicaps, and scoring calculations are provided for informational purposes.
We do not guarantee the accuracy of race results, handicap calculations, or any other data produced by the system. Users are responsible for verifying results and complying with applicable racing rules and regulations.
Limitation of Liability — Racing Events
Participation in yacht racing and related activities involves inherent risks. Regatta RC, MicroCODE, Inc., and its affiliates shall not be liable for any accidents, injuries, or damages occurring during or in connection with racing events, regattas, or any activities managed or scored using our software.
Organizing authorities, race committees, clubs, and event organizers using Regatta RC assume full responsibility for the conduct and safety of their events. We are not responsible for decisions made by race officials, scoring officers, or event organizers.
Termination
We may suspend or terminate your access to Regatta RC at any time, with or without cause or notice, including for violation of these terms.
General Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Third-Party Intellectual Property
Regatta RC supports multiple handicap and rating systems, including those administered by the Offshore Racing Congress (ORC), the Royal Ocean Racing Club (IRC), the Offshore Racing Rule (ORR), and various Performance Handicap Racing Fleet (PHRF) organizations. All rating system names, logos, certificate data, and associated intellectual property remain the sole property of their respective owners.
ORC certificates, ratings, measurement data, performance predictions, polar data, and all related content (collectively, "ORC Content") are the intellectual property of Offshore Racing Congress Limited. The appearance of ORC-related data within Regatta RC does not imply any transfer of ownership of that data to you or to MicroCODE, Inc. ORC Content is displayed and used under the terms established by ORC and is subject to the ORC Terms of Use available at orc.org.
You agree that any ORC certificate data you upload or access through Regatta RC will be used solely for purposes permitted by the ORC Terms of Use, including preparing for, competing in, or organizing events that invoke ORC Rules in their Notice of Race, or for verifying and analyzing your own vessel's rating. You shall not use Regatta RC to systematically collect, redistribute, or commercially exploit ORC Content.
Similarly, IRC, ORR, PHRF, and other third-party rating data displayed within Regatta RC remain the property of their respective issuing organizations. You are responsible for complying with the terms of use established by each rating authority whose data you access or upload through the platform.
